Canadian Seafood Company Fights Back on Temporary Foreign Workers Penalty

A New Brunswick shellfish processing company, Bolero Shellfish Processing, is arguing that the government agency presumed guilt in a temporary foreign workers matter but did not allow the company the right to a trial.

The company was issued a CAD 1.0 million ($716,954) fine for violations of Canada's Temporary Foreign Workers (TFW) program by Employment and Social Development Canada (ESDC) on Sept. 17.

The penalty is the largest ever issued by the government agency for violations of the TFW program, according to reports by CBC and Undercurrent News.

Bolero Seafood Processing, a division of Montreal, Quebec-based Sogelco International, is asking Canada's federal court to review the case.

The company is seeking a review of the case, citing a lack of due process.

The Bolero processing plant is located in Saint Simon, a small town on New Brunswick's Acadian Peninsula, about 75 kilometers east of Bathurst.
