Colorado Supreme Court Considers Expert Testimony on Child Witnesses

Members of the Colorado Supreme Court deliberated on the limits of expert testimony regarding the honesty of child witnesses.

Previously, the state's Court of Appeals ruled that a defendant who persistently argues an adult influenced a child victim to lie may allow an expert to testify on the absence of coaching signs.

“Given what else the expert has testified about, why isn’t it allowed for her to not directly talk about the veracity of the victim, but just to talk about whether she, in this case, had observed any of those indicators?”

Justice Carlos A. noted that jurors would naturally want to hear an expert's perspective when a defendant suggests coaching occurred.

The court is considering how far an expert can go in suggesting a child witness is truthful without directly commenting on their veracity.
